Terms & CondItions 

1. Photographer's Fee: (RETAINER)
May be negotiated or lessened during promotions.
Session Fee: $349 (Non-refundable Initial Payment) for Studio & Sessions located in Victoria
Session Fee: $599 (Non-refundable Initial Payment) for Sessions located overseas not part of retreats
Immediate payment of retainer fee required upon booking.

2. Reservation and Payment:
Date reserved upon full Agreement execution.
Payment secures venue, makeup artist, and session date.
Non-refundable payment acknowledges incurred costs.

3. Pre-Session Payment Plan:
No plans after the session.
10% discount for full payment via Cash, EFT, or Credit Card.
Payment Plan Setup call must be set up within 7 days after Retainer Fee payment.

4. Minimum Investment: $999.00 (Payment Plan $36 per week over 18 months with Payright)
Session details finalised; full payment required for session.

5. Location and Duration:
As directed and agreed.
Studio sessions in Melbourne: 3/7 Lewellin Grove, CARRUM.

6. Styling:
Client responsible; adjustments allowed.
Final choices irrevocable.

7. Completion Schedule:
Product delivery post-client approval.
Print: 4-6 weeks; Albums: 6-8 weeks; Expedited fee: $200.

8. Archival and Ordering:
No archival for unpurchased images.
All purchases during ordering appointment.

9. Products Included & Additional Purchases:
Charges based on Photographer’s Investment Menu.
Session Price (Retainer Fee): Covers services & hair and makeup; no products included.
Minimum investment: $1950.00; payable at least 30 days before session.

10. Ordering Process:
Scheduled Appointment for final orders; all sales final.
In-Person Product Sessions: Proofs presented via Zoom.

11. Payment Methods and Collection:
Acceptable: cash, credit card, Afterpay, or payment plan.
Client responsible for collection costs.
Album Review and Revisions:
Client approves album within 3 days.
Return defective albums within 10 days.
Additional revisions at $200; Photographer's image choice.

12. Electronic Transmission Risks:
Parties communicate electronically; Client consents to online communication and sharing. Images shared only with client permission. Revocation of a full permission at a later date incurs $1500 fee

13. Cooperation & Reasonable Communication:
Disclose issues before shoot.
Client to respond to emails within 2 days or session will be cancelled. (unless other circumstances apply at the time)

14. Behaviour and Cooperation:
Client's cooperation needed for desired photos.
Photographer not liable for uncooperative parties.

15. Photography/Videography Engagement:
No unauthorised recording during the session.
Violation allows Photographer to end the session without refund.

16. Cancellation and Rescheduling:
Amendment or cancellation 30+ days before allows rescheduling.
Failure within 30 days forfeits the non-refundable payment.
Late arrivals result in deducted session time; no partial refund.

17. Safe Working Environment:
Client abides by rules; inappropriate behaviour may lead to termination.

18. Indemnification & Liability:
Client indemnifies Photographer for claims.
Claims for artistic works within 1 week.
Damages not to exceed total monies paid.

19. Dispute Resolution & Non-Disparagement:
Claiming party informs in writing; mutual negotiation for 20 Business Days.
Unresolved disputes use a mediator; costs shared equally.
Confidential communications; this clause survives termination.

20. Non-Disparagement:
Client refrains from disparaging; negative reviews may lead to legal action.
This clause survives termination.

21. Legal Miscellany:
Agreement doesn't exclude Australian Consumer Law rights.
Photographer's liability limited by law; excludes negligence and consequential loss.
Goods and services provided without implied warranties; Statutory Rights apply.

22. Acceptance:
Client accepts on receipt of Deposit (Retainer Fee), written acceptance, or signed agreement.
Photographer starts services upon acceptance.

23. Agreement:
Must sign formal agreement within 1 business day of Retainer Fee; failure results in cancellation. No refund of Retainer Fee.
